DJI Files Dual Lawsuits Against Insta360 Over Luna Ultra's Similarity to Osmo Pocket 4P

Recently, Insta360 officially unveiled the Luna Ultra, a competitor to DJI's Osmo Pocket 4P. In response, DJI has initiated two lawsuits against Insta360, alleging patent infringements. The cases were filed in the United States, where DJI believes it has a stronger likelihood of success.

In its first lawsuit, DJI claims that Insta360 infringes on its design patents by manufacturing and selling the Luna series, asserting that the designs closely mimic its own Osmo Pocket line. While the similarities are evident, it remains uncertain whether DJI will succeed in obtaining an injunction that would halt sales of the Luna line in the US.

DJI specifically points out that the ornamental design outlined in one of its patents includes features such as the elongated handheld body, the neck connecting the body to the gimbal arm, gimbal assembly, and camera. Another patent covers elements like the rotatable display, control section with a scroll wheel and record button, side-mounted accessory slot, and the port opening at the base.

In its second lawsuit, DJI cites four utility patents that it alleges Insta360 has violated. One patent describes a control device for a gimbal that enables mode switching between follow and locked modes using a single control. Another patent addresses a handheld gimbal featuring integrated subject tracking and real-time display, negating the need for a separate app. A third patent relates to a gimbal control method where the device’s own image of the target directs the gimbal's motor commands, while the fourth patent concerns a self-contained system for tracking a subject and displaying the image on the gimbal’s screen.

Earlier this year, DJI also took legal action against Insta360 in China, accusing the company of poaching former DJI employees and utilizing stolen research and development to file drone-related patents.
